ABOUT LEGAL AID
Equal justice and free legal representation are guaranteed by Article 39A of the Indian Constitution. “The State shall ensure that the operation of the legal system promotes justice, on a basis that a fair chance at success, in particular by offering free legal assistance, through appropriate laws or programmes, or in any way a strategy to guarantee that chances for obtaining justice are not discriminated against by economic or other factors to any citizen disabilities” According to Section 9 of the Legal Services Authorities Act 1987, The State government has the power to assign a District Authority after taking proper consultation with the Chief Justice of High court of the concerned state. And according to Section 11 of the Legal Services Authorities Act 1987, the district authority has the power to act in coordination with other governmental and non-governmental institutions, universities and others engaged in the work of promoting the cause of legal services to the poor and also shall be guided by the directions as the Central or State authority may give to it in writing.
ABOUT THE LEGAL AID AND SERVICE CLINIC OF SCHOOL OF LAW AND JUSTICE, ADAMAS UNIVERSITY
The Legal Aid functions performed at School of law and justice are preventive, remedial, activist and reformative. Our aim is to spread legal awareness among students and people at large. We endeavour to achieve the target by organizing legal literacy camps, seminars, legal counselling, public speaking, poster making, street plays., jail visits and through various activities. The Legal Aid Committee of organises “Legal Awareness Camps” to enlighten people about the necessity of various laws and legal issues pertaining to such laws. The District Legal Services Authority of the district of North 24 Parganas, the NSS Wing of Adamas University and the NGO Relief Wing provides active contributors for various events. Eminent alumnus of School of Law & Justice, Adamas University remains there to explain the aspects of legal aid to the general people. Such type of events results to be a great learning experience for the budding lawyers of the school of law and justice.
LEGAL RIGHTS
- The provision of any service in connection with the conduct of any action or other legal proceeding before any court, other authority, or tribunal is referred to as providing “Legal Service” under Section 2(1)(c) of the Legal Services Authorities Act, 1987, as is providing legal advice on any matter.
- The primary goal of enacting the aforementioned Act was to give competent and free legal services to the less fortunate members of society. In the preamble of our Constitution, we swear allegiance to social, economic, and political justice.
- The inclusion of Article 39-A in the Directive Principles of State Policy in 1976 mandated that the State guarantee equitable access to justice by offering free legal aid, if their yearly income is less than the sum set forth by the applicable State Government, or less than Rs. 5 Lakhs, if the matter is before the Supreme Court.
- Therefore, free legal aid is required for those individuals since Article 14 of our Indian Constitution states that all people are equal and that all individuals, regardless of wealth or poverty, are entitled to justice.
OBJECTIVE: –
- To offer legal aid to the underprivileged and weaker members of society.
- To offer accessible, affordable local equipment for handling fundamental legal services such legal advice and the writing of petitions, notifications, answers, and other important legal documents.
- To settle locals’ issues through conciliation and mediation in order to avoid having them go to court.
- To provide clinical education as a component of practical training and to instill in the students a commitment to social service in order to aid the society’s most vulnerable groups.
LEGAL AID AND SERVICE CLINIC / LEGAL AWARENESS ACHIEVEMENTS OF SCHOOL OF LAW AND JUSTICE, ADAMAS UNIVERSITY KOLKATA
- A social awareness program was conducted in Sadarpur in order to aware the natives and villagers about how Child marriage ends childhood. It negatively influences children’s rights to education, health and protection. These consequences impact not just the girl directly, but also her family and community.
- We are constantly mentored by our professors and alumni of our university. We conduct programs in the form of a dramas, poster display, etc. Netizens responses are generally recorded.
